It is Wednesday, May 5. Happy Cinco de Mayo. Here are today’s top stories.

Facebook’s Oversight Board, which is independent from the company leadership, said it has upheld Facebook’s decision to restrict then-President Donald Trump’s access to posting content on his Facebook page and Instagram account the day after the Capitol insurrection.

However, the Board said Facebook acted inappropriately by “indefinitely suspending” Trump, saying it needs to decide whether it just wants to remove certain content, or impose a time-bound period of suspension, or permanently disable the page and content.

The Board said Facebook needs to make up its mind on what to do with Trump’s account within six months.

Trump released a statement today that said “Free Speech has been taken away from the President… because the Radical Left Lunatics are afraid of the truth… These corrupt social media companies must pay a political price.”

AP News reported that a grand jury has indicted a police officer in Bristol, Virginia of murder and other charges for shooting and killing a 31-year-old man who was driving his car.

AP explained that the officer, Jonathan Brown, and other cops responded to a 911 call of shots fired at a motel on the early morning of March 30. They encountered a suspect named Jonathan Kohler who was seated in a red Ford Mustang. Officers said he refused to exit his vehicle and instead backed up and drove forward to try and escape the parking lot, and that’s when Brown opened fire and killed Kohler.

Both Brown and Kohler are white.

Prosecutors did not explain what evidence it presented to a grand jury that led to the murder indictment, saying the evidence will be presented during trial.

There have been more incidents of attacks against Asian Americans in the news.

On Sunday night in New York City, two Asian females who were 31 and 29 years old were attacked by a woman swinging a hammer who demanded they remove their masks. The 31-year-old woman had a laceration on her head. The New York Police Department has released a video of the attack and asked the public’s help to identify the suspect. The NYPD said they’re looking at it as a possible hate crime.

The second incident was on Tuesday night in San Francisco. Police said a man used a large knife to stab two older Asian American women at a bus stop without warning. One woman was 85 years old and the other was in her 60’s. ABC 7 reported that both women were hospitalized and had to undergo surgery. Last night police announced they arrested a 54-year-old male suspect. Police said they don’t have evidence it was a hate crime, but are investigating.

Peloton announced it is recalling all of its treadmills out of mounting safety concerns after a 6-year-old child died in a treadmill accident in March.

The U.S. Consumer Product Safety Commission (CPSC) said it received 72 reports of people, pets or objects being pulled under the rear of the treadmill. Peloton’s treadmills’ design is higher off the ground compared with most treadmills.

Peloton initially refused to issue a recall, but the CEO John Foley is now apologizing for not quickly cooperating with the CPSC and is recalling over 125,000 treadmills. Peloton said customers who already have the products should stop using it and contact them for a full refund.

In Mali, a 25-year-old woman has given birth to nine babies via caesarean section. The mother, Halima Cisse, was expecting seven babies, but ultrasounds missed two extra babies. Now Cisse is the mother to five new girls and four new boys. The term for 9 babies is a “nonuplet” and it is very rare.
